Kenya's short-term rental market is growing fast. But there's a gap almost nobody talks about: most Kenyan Airbnb hosts operate with absolutely no written rental agreement between them and their guests.
They rely on Airbnb's own house rules field, a WhatsApp message, or nothing at all. And most of the time, nothing goes wrong — until it does.
What Exactly Is a Short-Term Rental Agreement?
A short-term rental agreement (sometimes called a vacation rental contract or Airbnb guest agreement) is a written document signed — or digitally accepted — between a host and a guest before check-in. Unlike Airbnb's generic platform terms, a proper agreement is specific to your property, your house rules, and Kenyan law.
It typically covers:
- Check-in and check-out times, and what happens if a guest overstays
- Security deposit terms and exactly how damage claims are handled
- House rules — smoking, parties, extra guests, pets
- Liability and indemnity — who is responsible if someone is injured on the property
- Cancellation and refund terms specific to your property, not just Airbnb's default policy
- What happens in the event of property damage, theft, or unauthorized subletting
What Happens When Kenyan Airbnb Hosts Skip This
As a practising Advocate who also runs short-term rental properties myself, I've seen — and personally handled — the fallout when hosts skip this step:
- Damage disputes with no paper trail. Without a signed agreement specifying deposit and damage terms, a host's only real recourse is Airbnb's Host Guarantee — which is slower, more limited, and far less certain than a direct claim under a signed contract.
- Guests who overstay and refuse to leave. Without clear, written check-out terms, this becomes a much murkier legal situation than most hosts expect.
- Unauthorized parties or extra occupants that violate estate or building management rules, leaving the host exposed to the landlord or management company with no contractual backing to hold the guest accountable.
- Confusion over refunds when a guest wants to cancel outside of Airbnb's own policy window.
None of these are rare, dramatic scenarios — they're the ordinary, unglamorous risks of hosting. A proper agreement doesn't prevent every problem, but it puts you in a completely different position when one arises: you have something in writing to point to, signed by the guest before they ever got the keys.
Why "Lawyer-Vetted" Actually Matters (Not Just Marketing Language)
There are free templates online, and increasingly, AI tools that generate a rental agreement in under a minute. Both can seem like an easy shortcut. Here's the problem: a generic or AI-generated template doesn't know that Kenyan tenancy law includes specific frameworks like the Rent Restriction Act (Cap 296) and the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act (Cap 301) — and more importantly, doesn't know how those frameworks interact (or don't) with short-term, Airbnb-style stays specifically, which is a different legal context from a standard residential tenancy.
